These are challenging times for lawyers representing individuals against big business. Tort reform protects special interests from the harm their products cause individual consumers. Punitive damages awards no longer serve as a deterrent against an insurance company’s future conduct. Pursuing a small claim through litigation now costs more than the insured likely will recover after trial and the inevitable appeal.
So how does a lawyer achieve justice for a policyholder in today’s climate? Our panel, which consists of our attorneys as well as guest speakers Gerald G. Knapton, Joann Selleck, Ellen A. Pansky, David B. Parker and Michael E. Wine, will offer their insights in light of recent appellate decisions and their own practical experience.
