Kimbell, et al. v. Abercrombie & Fitch Stores

 

Mr. Kimbell retained The Quisenberry Law firm to represent him and all others similarly situated in their effort to be paid for overtime work.  Mr. Kimbell was a Store Manager at Abercrombie & Fitch.  Although the work he performed was substantially similar to that of the hourly employees who received overtime pay, he, along with other managers in California, were not paid for the overtime hours that they worked.  Our complaint alleged that the Store Managers were misclassified as exempt employees and were entitled to overtime pay, even though they were salaried employees.  In September 2004, we were successful in certifying the class.  This paved the way for us to settle the suit for $2 million in January 2006.
